Notable Recent Court Cases
Dallas County: Assisted the grieving mother of a worker killed on a construction site. The matter was resolved swiftly.
Parker County: Assisted Developer-client (Defendant) in a trespass action brought by neighboring development for alleged encroachment of a retaining wall, as leverage for obtaining a favorable easement agreement. Plaintiff non-suited after a few months after the minor encroachment was removed and an as-built survey was produced, as Plaintiff had no actual damages.
Dallas County: Assisted Builder-client (Defendant) in a personal injury/construction case brought by a purchaser for injuries by “bird mites” she allegedly sustained from defective installation of vents. Plaintiff non-suited after a few months during written discovery and motion practice related to the same.
Tarrant County: Assisted property owner-Client (Plaintiff) in wrongful lien action by interior remodeling contractor of a tenant. The judge in that matter ordered the lien removed; awarded attorney’s fees and court costs against Defendant.
Collin County: Assisted property owner-Client (Plaintiff) in wrongful lien action by sales agents working for a roofing contractor. The judge in that matter ordered the lien removed; awarded attorney’s fees and court costs against Defendants; and my client’s lien bond fee was ordered to be released.
Collin County: Assisted Builder-client (Defendant) in a personal injury case brought by an Independent Contractor for injuries he sustained on the job. Plaintiff non-suited a few days prior to the trial date.
Dallas County: Assisted Investor-client (Defendant) with dissolving the TRO and denial of Application for Injunction filed by the previous property owner who had filed, among others, wrongful foreclosure and trespass to title cause of action. Plaintiff was forced to vacate the property after the dissolution of TRO and denial of their Application for Injunction, and subsequently non-suited their causes of action with prejudice.
Dallas County: Assisted a business investor (Plaintiff) in a business partnership dispute against her dishonest business partner who agreed to return my client’s investment at mediation. This matter was non-suited after receipt of payment from the opposing party.
Dallas County: Successfully Defended a used auto dealership against claims of Fraud and Violation of Texas Theft Liability Act (TTLA) brought by co-owner of a vehicle used as a trade in. The Dallas County Court at Law granted our Motion for Summary Judgment and all of Plaintiff’s causes of actions were dismissed with prejudice. This meant the Plaintiff was responsible for our client’s reasonable attorney’s fees and court costs under the TTLA. We also counter-sued the Plaintiff and further sued the other co-owner. Plaintiff and third-party Defendants agreed to our settlement terms in return for non-suit of our actions against them. In the end, our client protected its reputation and good name, and Plaintiff was compelled to honor the trade-in.
Denton County: Successfully evicted a commercial tenant and obtained judgment for client for past due rent and attorney’s fees against the non-performing tenant.
Collin County: Successfully defeated attempts by an aggressive attorney to subject an elderly and sick woman to “torture by litigation” in an attempt to pressure the family members into settlement of a dispute. The court in this matter issued a permanent protective order against Plaintiff and her counsel. Plaintiff’s strategy backfired and Plaintiff ended up agreeing to an unfavorable settlement agreement.
