Texting-While-Driving Law

Texting-While-Driving Ban Goes Into Effect Across Texas

“A clear law that has the power of the enforcement can give Texas businesses the ammunition they need to protect their bottom line from the liability of texting while driving” — Todd Clement

Starting today, September 1, 2017, you will receive a citation for texting while driving within the state of Texas. The citations will be punishable by a fine of $25-99 for first-time offenders, and $100-200 for repeat offenders. There will be no points assigned. The new law only addresses “reading, writing, or sending electronic messages” via a “wireless communication device.” It is still legal for motorists in most cities to use their phone for GPS navigation, music apps, browsing the internet, dialing phone numbers, etc., but drivers may still get pulled over if an officer suspects them of texting.

In the Dallas News interview, The Dallas Police Association’s legislative chair, Frederick Frazier, said the law would most likely be used as a tool rather than have police actively searching for violators of the law. Although he supports the measure, Frazier said the Dallas Police Department’s officer shortage won’t allow it to focus all its efforts on something “minor.”

“This is something for our traffic division, but our traffic division is very watered down,” Frazier said. “Our department is so low on manpower that everything is shifted to 911 calls.”

Furthermore, the new law also states that if an accident caused by texting and driving results in the death or serious bodily injury of another person, the driver can be charged with a Class A misdemeanor punishable by a fine not to exceed $4,000 and confinement in jail for a term not to exceed one year.

Chalaki Law firm has always been a long-time advocate against texting and driving. Recently all of us were devastated by the death of 13 passengers in a church bus who were killed by a truck driver that was texting and driving. In 2016, there were 109,658 traffic crashes in Texas alone that involved distracted driving, leading to over 3,000 serious injuries and at least 455 fatalities.  Over the years of practicing personal injury law in Texas, we often see cases of individuals who were severely injured or who have died because a negligent driver was texting and driving. Texting and driving is a distraction and also slows your reaction time. This law will save lives, money and improve our society.

Our firm is available to answer any of your questions regarding personal injuries. If you have been a victim of texting and driving in Texas, contact our experienced Personal Injury Attorneys to get an initial Free Case Evaluation. Stay safe, stay strong, be a good Texan.

A Personal Injury Lawyer Explains

Personal Injury Explained

The practice of Personal Injury Law protects your rights after you suffer injuries to your person due to another person’s act or omission of an act of negligence or wrongdoing. Your injuries could be caused by car accidents, slip and fall, product defects, dog bites, or other factors. In these situations and others you have the right to be compensated for your damages including your pain and suffering. People can be injured at home, work, job sites, on the road, at the stores, or anywhere they may travel.

There are several other factors that need to be taken in consideration when making your personal injury claim. First, all parties responsible for the accident needs to be identified and held liable.

Second, you may have a claim against your own insurance depending on the policy you have.

Third, you may have other legal options in recovering more than just your damages if the individual was grossly negligent or violated the law while committing the tort. Moreover, there are other factors that need to be taken in consideration which you can further consult with DFW personal injury lawyer who have the proper experience in handling such cases.

Liability is a key factor in handling personal injury cases. Liability can be determined by proving that the individual who caused the harm did so because he/she did not act as a reasonable person would have in the same circumstances. If the opposing party fails to properly investigate the case and denies liability you may be entitled to file a lawsuit and recover your damages.

It is important to note that many personal injury cases never make it to the courts. Out-of-court settlements are often chosen to resolve the issue because they are not as lengthy or costly. If a settlement cannot be reached then the case will be presented to the court of proper jurisdiction for litigation.

When you are injured in any form of accident, there are actions that must be taken. First and foremost, inform the police. Seek medical help for your injuries immediately. Lastly, gather evidence, photos, and information on the accident and injuries. This includes talking to witnesses and taking down their names and addresses. You should also write a personal account of the incident while the details are fresh in your mind.

Three dead in crash near Wylie TX

Three killed in two-vehicle crash

April 01, 2016 4:32 PM

WYLIE TX — One adult and two children have died in a crash that has led to the closure of Highway 78 in both directions just south of State Highway 205 near Wylie.

The accident occurred just before 2:15 p.m. south of Lavon near Rettop Road, according to Sgt. Lonny Haschel with the Texas Department of Public Safety.

The adult victim was identified as Peter Hacking, who served as a captain with the Nevada, Texas, volunteer fire department. He was named the department’s volunteer of the year in 2015.

Authorities say the driver of a van carrying two passengers was headed southbound on Highway 78 and somehow lost control of the vehicle, which swerved into northbound traffic. The van struck a car, killing all three people inside.

The three occupants of the van were transported to Medical Center of Plano with serious injuries.

According to Wylie Texas Fire Rescue, the road re-opened in both directions around 9:30 p.m. Thursday.
